Regeltante offers parties the opportunity to contact each other through the agency of Regeltante in order for parties to enter into an Agreement with each other. The candidates screened by Regeltante are not in the employ of Regeltante and nor is there any relationship of authority.
Article 1: Definitions
The following terms and associated meanings are used in these terms and conditions:
- Regeltante BV: a national intermediary for homeworkers.
- Client: the party submitting an intermediation request to Regeltante for the supply of homeworkers in the broadest sense of the word.
- Candidate: the party offering to enter into an Agreement with the Client through the intermediation of Regeltante for the provision of certain services, in the broadest sense of the word.
- Agreement: the Agreement between the Client and Candidate. It is expressly stated here that Regeltante is not a party to this Agreement.
- Match: a connection between a Client and a Candidate, as realised through the services of Regeltante.
Article 2: Applicability
These terms and conditions form an integral part of all other agreements and offers that are realised through the intermediation of Regeltante, unless the parties depart expressly and in writing from these terms and conditions.
Article 3: Clients
- Clients may register by completing the registration form on the website in full. In doing so, they opt each time for the service they require and indicate which package they wish to choose.
- If the Client immediately pays the outstanding costs online and when the amount has been deposited in the bank account of Regeltante, the search can commence immediately. The Client may then make use of all the facilities offered by Regeltante to its clients.
- The period of validity of the search lasts between one and no more than four months, depending on the chosen service package and is indicated on the website.
- The Client is given the opportunity to select Candidates him/herself by means of a designated personal link or login data via “Mijn Regeltante”.
- The Client may place suitable Candidates in “Mijn contacten” and subsequently contact the Candidate him/herself.
- The Client may retrieve the contact data of as many candidates as he/she sees fit, but may reserve a maximum three candidates depending on the chosen service package. A Candidate may be reserved for a maximum period of three days.
- Clients are obliged to provide feedback when retrieving contact data and making reservations. Only Regeltante may view feedback from clients.
- If negative feedback is given in respect of a Candidate on three occasions, Regeltante may delete said Candidate from its database.
Article 4: Candidates
- Candidates may register for intermediation by completing the registration form on the website.
-
Incomplete or incorrectly submitted registrations will not be processed. Regeltante also reserves the right to reject candidates that it has in the past deleted from its database.
- Candidates agree to telephone screening by Regeltante.
- Candidates are not obliged to pay any registration fee.
- The Candidate may present him/herself on the website by means of a profile. The Candidate may also take the initiative to approach clients he/she would prefer to work for.
- The Candidate undertakes to abide by the agreements reached with the Client.
Article 5: Obligations of Regeltante
- Regeltante has screened all the candidates presented through its database.
- Depending on the package chosen by the Client, Regeltante discusses the wishes and requirements with the Client, informing him/her of the various options.
- Regeltante offers candidates and clients the best possible information about the situation in this way.
- Regeltante offers its clients and candidates unlimited access to its database and offers them the opportunity to take part in its platform and to participate in workshops.
- In consultation with its clients, Regeltante offers them the opportunity to post advertisements on its website.
- While Regeltante is not a party to the contacts and agreements between Client and Candidate, Regeltante will endeavour to empathise with the situations of both parties and seek to mediate, should a problem unfortunately arise.
Article 6: Liability
- While Regeltante will do everything in its power to safeguard the highest possible standard of its organisation, it cannot accept responsibility for the ultimate quality of the work provided by selected candidates.
- Regeltante shall be liable insofar as this ensues from legislation or the Agreement.
- Regeltante cannot be held liable in the event that a Candidate has failed to fulfil an Agreement with a Client.
-
Regeltante shall not be obliged to pay compensation for any damage or loss deriving from force majeure. Force majeure shall be deemed to be any unforeseeable circumstances as a consequence of which the execution of the Agreement may be delayed or prevented, insofar as this has arisen from force majeure.
- Regeltante offers its services via the internet. If Client and Candidate are unable to make use of internet connections owing to technical malfunctions or other circumstances, as a result of which they are unable to consult the Regeltante database, Regeltante cannot be held liable for this, unless the malfunction can be attributed to the intent of Regeltante.
Article 7: Termination
- The search is entered into for an agreed period of time depending on the chosen package.
- Termination within the aforementioned period of time will not result in a refund of the amount paid by the Client.
- Regeltante may deregister clients and candidates if it emerges that they have supplied incorrect information.
- Regeltante may deregister candidates if they fail to attend two appointments with the potential Client or if Regeltante has received poor feedback about them on three occasions.
- The search ends by operation of law in the event of the Client’s death.
Article 8: Cancellation of the search
- Following the registration date that appears on the website, the Client is entitled to cancel the search up to and including 7 days thereafter. Cancellation is no longer possible after said 7-day period, or at least cancellation is possible without any refund to the Client.
- Cancellation must be effected in writing. Only in the event that the Client has not searched for candidates via the website within this period may the registration fee be refunded to the Client. Administration charges are never refunded.
Article 9: Complaints
- Complaints regarding the search may be submitted no later than 14 days following the event prompting the complaint.
- If complaints are submitted after the aforementioned period, Regeltante reserves the right to declare the complaint inadmissible for processing.
Article 10: General provisions
- The terms and conditions as included in the present document shall apply to all agreements entered into by RegeltanteBV.
- Parties may agree to depart from the provisions of the terms and conditions. Both parties must expressly agree to any amendment and the amendment must be recorded in writing.
- In those cases not provided for by the terms and conditions, parties shall seek a solution, assessed against the principles of reasonableness and fairness.
Article 11: Applicable Law
The Laws of the Kingdom of the Netherlands shall apply to agreements between Regeltante and third parties and the present terms and conditions. Any disputes must be submitted to the competent Court at Amersfoort.
